Terms of the agreement
These terms apply to agreements between Art Of Ground Games Oy and consumers for Brazilian Jiu-Jitsu training and related services. They are effective from 7 October 2026.
If there is a discrepancy between the Finnish and English terms, the Finnish terms shall prevail.
I. PARTIES AND DOCUMENTS
- The agreement is made between Art Of Ground Games Oy (Business ID 3113108-9, "AOGG") and the member. The member is an adult private individual who purchases the membership and is responsible for its payments. If the person training is a minor, the member is their guardian, and the sections concerning payments, termination and other contractual actions apply to the guardian.
- The AOGG App is AOGG's customer management system (provided by Gymdesk), used to purchase memberships, handle payments and manage the membership.
- The agreement consists of the order confirmation, these terms, the price list and the academy rules. In case of conflict, they apply in this order. The processing of personal data is described in the privacy policy.
II. FORMATION OF THE AGREEMENT
- These terms are available before purchase. The agreement is formed when the first training fee has been paid. By paying, the member accepts these terms.
- The member receives an order confirmation by email, stating the membership type, price, any contract period and continuation price, and a link to these terms.
- The membership and access rights are personal and cannot be transferred to another person, unless stated otherwise in these terms.
III. MEMBERSHIPS AND GYMS
- The monthly membership is valid until further notice.
- The 12-month agreement is fixed-term. Training fees are charged monthly and are payable for the entire contract period.
- The annual membership is paid in advance in one payment and is valid for 12 months.
- Continuation. After the period ends, the 12-month agreement and the annual membership continue as a monthly membership valid until further notice at the price list rate, unless the member terminates the agreement before the period ends. The continuation price is shown in the order confirmation. AOGG will notify the member of the continuation and the continuation price in euros no later than 30 days before the period ends.
- The beginner course is a one-time purchase and ends after the last session of the course. It does not continue as a membership unless the member purchases one separately.
- Gyms. The membership entitles the member to train at all AOGG gyms. The home gym is the gym through which the membership was purchased.
- Prices and membership contents are described in the price list. Other fees and the conditions for open training are set out in these terms and in the academy rules.
IV. RIGHT OF WITHDRAWAL
- A membership purchased online or in the AOGG App may be withdrawn within 14 days of purchase without giving a reason, using the withdrawal function in the AOGG App or by email to members@artofgroundgames.com.
- If the member has booked or attended a training session during the withdrawal period, the member has requested the service to begin before the withdrawal period ends. If the member then withdraws, they pay for the time used. The daily price is the monthly training fee divided by 30, and for the annual membership the price divided by 365. The remainder is refunded within 14 days using the original payment method.
- The beginner course is held on pre-announced dates, and the statutory 14-day right of withdrawal does not apply to it. The course fee is refunded in full if a refund is requested in the AOGG App or by email no later than 23:59 on the first training day of the course. After that the fee is not refunded, but the member may transfer to the next course once at no extra cost. If AOGG cancels the course, the fee is refunded.
V. TRAINING FEES AND PAYMENT
- The first training fee is charged at the time of purchase as stated in the order confirmation. After that, training fees are charged in advance on the 1st of each month to the payment card saved in the AOGG App. The training fee is payable regardless of how often the member trains.
- Training fees may also be paid with sports benefits accepted by AOGG or by an employer or another party. If such a payment has not arrived by the due date or does not cover the full fee, the remainder is charged to the payment card. Refunds are made using the original payment method.
- If the member chooses invoice as the payment method, an invoicing fee of €5 is charged for each invoice. No invoicing fee is charged if an invoice is sent because a card payment failed.
- If the basis for a discounted price, such as a student price, ends, the member must notify AOGG. The price changes to the normal price from the beginning of the following month. If the member fails to notify AOGG, AOGG may charge the difference for the period during which the basis was not met.
VI. LATE PAYMENT
- If a charge fails, the training fee is still due on the original due date, and late payment interest accrues under the Interest Act.
- If payment has not been made within 14 days of the due date, AOGG sends a payment reminder by email. A fee of €5 is charged for the reminder. Fees that have fallen due at the same time are collected with the same reminder.
- If payment has not been made by the due date of the reminder, AOGG may suspend the right to train and transfer the claim to debt collection. Collection costs are determined under the Debt Collection Act. Suspension does not end the agreement or the obligation to pay. The right to train is restored once overdue payments and costs have been paid.
- If payment remains unpaid 60 days after the due date, AOGG may terminate the agreement under section XII.
- The member's payments are allocated first to the oldest overdue amount.
VII. FREEZING THE MEMBERSHIP
- The membership can be frozen in the AOGG App or by email. A freeze starts at the beginning of the following month if requested no later than the 15th of the preceding month. Freezes are made in full months, for no more than 6 months at a time, and require that the member has no overdue payments.
- The first freeze month in each calendar year is free of charge. After that, €10 is charged for each started freeze month.
- For the period of military or non-military service, the membership can be frozen free of charge for the full duration of service. A call-up order must be provided.
- During a freeze, the member has no right to train. A fixed-term agreement is extended by the length of the freeze.
VIII. TERMINATION AND EARLY ENDING OF FIXED-TERM AGREEMENTS
- The notice period for a membership valid until further notice is one calendar month: the agreement ends on the last day of the calendar month following the notice. Example: notice given on 12 March, the agreement ends on 30 April, and the last charge is on 1 April.
- Notice is given in the AOGG App or by email to members@artofgroundgames.com. Within 7 days, the member receives a confirmation stating the end date of the agreement and the last charge.
- A fixed-term agreement cannot be terminated during the period, except in the situations described in sections VIII.4, VIII.5 and XI.4.
- Serious reason. A fixed-term agreement may be terminated with one month's notice and without other fees if training at AOGG is no longer possible due to an unexpected change in the member's life that is beyond the member's control. Proof of the reason must be attached to the notice. Such reasons include, for example: an illness or injury lasting at least 3 months that prevents training; moving so that the new home address is more than 50 km from the nearest AOGG gym; and military or non-military service.
- Early termination fee. A 12-month agreement may also be ended early for other reasons by paying an early termination fee. The agreement ends at the end of the current calendar month, and the fee is 50% of the total training fees remaining in the contract period. Time added by freezes is included in the remaining period. The fee is due on the end date of the agreement. Example: training fee €69.90 per month with 7 months remaining. The remaining fees total €489.30, and the early termination fee is €244.65.
- The ending of the annual membership is governed by section IX.
IX. ANNUAL MEMBERSHIP: COMPENSATION AND ENDING
- The price of the annual membership does not change during the period. Paid training fees are not refunded unless required by law or these terms.
- If the member is entitled to compensation, AOGG primarily compensates by extending the membership.
- If training is no longer possible for a serious reason (section VIII.4), the member wishes to stop, or AOGG terminates the agreement, the member may choose one of the following for the remaining period: a transfer to another person, a conversion into a family member's membership, or AOGG credit usable for AOGG services and products for 24 months. The recipient of a transfer accepts these terms. AOGG may refuse a transfer for a justified reason, for example if the recipient is banned from the gyms.
- If none of the options in section IX.3 is possible and the reason is a permanent serious reason or the permanent closure of the home gym, unused full months are refunded. The value of one month is the membership price divided by twelve.
X. CHANGES TO PRICES AND TERMS
- The price and terms of a fixed-term agreement remain the same for the entire contract period.
- For agreements valid until further notice, AOGG may change the price, these terms and the academy rules by notifying the member by email at least 30 days before the change takes effect. If the member gives notice before the change takes effect, the increased price does not apply during the notice period.
- Changes that benefit the member, and changes required by law, authorities or safety, may take effect immediately.
XI. SCHEDULES, CLOSURES AND COMPENSATION
- AOGG may change schedules, training content and instructors. Gyms may be closed or have shorter opening hours on public holidays and during the summer season. Gyms may be closed temporarily for maintenance, renovation, camps or events. Changes and closures are announced by member email and in the AOGG App as early as possible. These do not entitle the member to compensation.
- If the home gym is closed for more than 14 consecutive days, or all gyms for more than 7 consecutive days, the closure period is credited in proportion to the training fee on the next charge. For annual memberships and 12-month agreements, AOGG may compensate by extending the agreement. The reason for the closure does not affect compensation.
- Temporary access control disruptions do not entitle the member to compensation. Longer disruptions are governed by section XI.2.
- If the home gym closes permanently or moves more than 10 km away, the member may terminate the agreement to end on the date of closure or relocation. This also applies to fixed-term agreements, and no early termination fee is charged. For annual memberships, sections IX.3 and IX.4 apply.
XII. AOGG'S RIGHT TO SUSPEND OR TERMINATE THE MEMBERSHIP
- Removal from a session. An instructor may remove a member from a training session if the member endangers their own or others' safety, does not follow instructions or breaks the academy rules.
- Warning. If a member materially breaches these terms or the academy rules, AOGG gives a written warning. If the breach is repeated after the warning, AOGG may terminate the agreement.
- Immediate termination. AOGG may terminate the agreement immediately without warning if the member uses or threatens violence; harasses or intimidates others, including sexual harassment; trains intentionally or recklessly in a way that endangers others' safety; is intoxicated; commits theft or vandalism; uses AOGG's premises without authorisation, for example while the right to train is suspended; or commits another act of comparable seriousness.
- Suspension during investigation. If AOGG is investigating grounds for immediate termination, it may suspend the right to train for the duration of the investigation, for no more than 30 days. The member will be given an opportunity to present their view. If the grounds are not confirmed, the suspension period is credited.
- Termination for non-payment. AOGG may terminate the agreement in accordance with section VI.4.
- Termination without cause. AOGG may terminate an agreement valid until further notice with the notice period stated in section VIII.1.
- Notice. AOGG notifies the member in writing of a termination and its grounds.
- Payments on termination. Payments due by the termination date must be paid, including costs. The current month's training fee is not refunded. If AOGG terminates a 12-month agreement under sections XII.2, XII.3 or XII.5, the early termination fee in section VIII.5 is also charged. For annual memberships, section IX.3 applies.
XIII. UNAUTHORISED USE
- If a member brings or lets into the gym a person who has not registered with AOGG in advance as required by these terms and the academy rules, the member is charged compensation for unauthorised use. The compensation is the drop-in price (€15) for each such person and each visit. The member is also liable for damage caused by the person they brought.
- A written warning is given for the first occurrence. If it is repeated, AOGG may terminate the agreement.
- Unauthorised use may result in a ban in accordance with the academy rules.
XIV. TRAINING RISKS AND LIABILITY
- Brazilian Jiu-Jitsu is a contact sport with a risk of injury even when everyone acts correctly and follows instructions. By training, the member accepts the risks typical of the sport.
- The member is responsible for ensuring that their health allows training, and for their own actions in training. Damage caused by another training partner is the responsibility of the person who caused it, in accordance with the law.
- AOGG is liable under the law for damage caused by the negligence of AOGG or its staff, for example inadequate supervision, instruction or equipment condition. AOGG is not liable for injuries that occur in normal training without such negligence.
- Open training. If the membership includes access to the gyms outside instructed sessions, no instructor or staff is present at those times. The member trains at their own discretion and is responsible for making training safe for themselves and others. AOGG is responsible for the condition of the premises and equipment. Another person may take part in open training only if they have registered with AOGG in the AOGG App before the visit.
- The membership does not include insurance. AOGG recommends accident insurance that covers martial arts. Check that your insurance does not exclude martial arts.
- AOGG is not liable for property left at the gyms unless the damage results from AOGG's negligence.
XV. MINORS
- The membership of a person under 18 is purchased and terminated by the guardian, who is responsible for payments and for ensuring that the child follows the academy rules.
- AOGG is responsible for supervising the child during instructed sessions. Before a session starts and after it ends, the child is the guardian's responsibility.
- Minors aged 15 or over may take part in open training unless the guardian informs AOGG that they do not allow it. During open training, the minor is the guardian's responsibility. Children under 15 may not take part in open training.
- When the person training turns 18, the membership continues in the guardian's name until the guardian terminates it or it is transferred to the person training.
XVI. COMPETITION TEAMS
- The adult competition class is included in the membership. The kids' competition team has an additional fee as stated in the price list.
- Members are selected for competition teams based on the coaches' assessment. Coaches may move a member from a competition team back to a regular group if the selection criteria are no longer met. The member is notified in advance. For the kids' competition team, the price changes to the regular membership price from the beginning of the month following the move.
- Competition fees, licences, competition insurance and travel costs are not included in the membership.
XVII. PHOTOGRAPHY, MESSAGES AND PERSONAL DATA
- AOGG photographs and films training sessions and events and publishes material on its own channels and in its marketing. A member who does not want to appear in published material can notify AOGG in the AOGG App or by email. AOGG removes already published material in which the member is identifiable within a reasonable time on request. Images of persons under 18 are published only with the guardian's permission. AOGG does not film in changing rooms or bathrooms.
- AOGG sends messages related to the agreement and billing, such as invoices, due date reminders and payment confirmations, by email and to the phone number provided by the member as a text message or on WhatsApp. Payment reminders, price changes and notices about ending the agreement are always also sent by email. These messages are not used for marketing.
- AOGG sends notices to the email address saved in the AOGG App. The member must keep their contact details up to date.
- The processing of personal data, camera surveillance and marketing are described in the privacy policy.
XVIII. OTHER SERVICES
- Private sessions, seminars, camps and events are governed by the terms stated at the time of purchase. If no separate terms have been stated, the fee is refunded if cancelled no later than 24 hours before a private session, 48 hours before a seminar, 2 weeks before a camp, or before an event starts.
- Services cancelled later or not used are not refunded, but a place at a seminar, camp or event may be transferred to another person by notifying AOGG before the event. If AOGG cancels the service, the fee is refunded.
XIX. COMPLAINTS, DISPUTES AND LANGUAGE
- If the member is dissatisfied with the service or billing, they can contact members@artofgroundgames.com. AOGG replies within 14 days.
- If the matter is not resolved, the member can contact consumer advisory services and refer the matter to the Consumer Disputes Board. A consumer may also bring an action in the district court of their place of residence. Finnish law applies to the agreement.
- These terms are available in Finnish and English. In case of differences between the language versions, the Finnish version applies.
XX. ENTRY INTO FORCE
- These terms enter into force on 7 October 2026 and apply to all agreements made on or after that date.
- For agreements valid until further notice made before that date, these terms apply 30 days after the member has been notified of the change.
- For fixed-term agreements made before that date, these terms apply immediately to the member's benefit. Sections concerning new fees apply to them only after the contract period ends.
